How Does Mediation Work?
A mediator will meet with both you and your spouse in person to lead a discussion about issues related to your divorce, such as who gets what property and how child custody will be divided. Mediation is typically less stressful, less expensive, and less time consuming than a divorce trial. You and your spouse ultimately have the final say over your divorce, so mediation has the added bonus of allowing couples to maintain control of their divorce, as opposed to asking a judge to decide. The steps of mediation:
- One on one conversation with the mediator: You and your spouse will speak with the mediator individually to discuss your situation and desires.
- The initial meeting: All three of you will meet in person to review the details of your separation and the issues at hand.
- Negotiations: You will then meet in person for a series of negotiations that will end once everything is resolved. Depending on how many issues you have to settle (child support, property division, and so on) and how much you are able to agree on this may take one or more meetings.
- Completing the agreement: Once all the issues have been discussed and decide upon, the mediation will end, and you will be able to finalize your divorce.
